| Re: HELP: Apt complex says yes to Rot but now says I have to get rid of him I'm very surprised that since the adoption papers you have say MIXED BREED on them that they would make you get rid of him. After all what proof do they have he is a full blood Rottie. Two. what about the other tenants that have dogs that are clearly listed in the lease agreement as not allowed. They have not enforced the policy in the past why are they starting now? More importantly why are they singeling you out and treating you different? I know you dont want to involve the other tenants and cause trouble for them, which is respectable but if there are 4 or 5 other tenants in that complex that are suddenly being threatened by a policy that management was negligent to enforce in the first place they have a much bigger problem on their hands and they may decide to bend or flex. If nothing else it could give you a few months of grace to find another place or something. In all reality if they forced you to remove your dog and they let the others keep their dogs against their own policy that could be grounds for some kind of legal action. Fair and consistant is fair and consistant. If its in writing there is no gray area they either have to enforce it for everyone or decide not to enforce the policy at all. They cant pick and choose who's German shepard is good and who's rottie is bad. I think you have more leg to stand on than you might think. I still would look into a new place if I were you but presenting it to them in that fashion may at least by you some time. |

You make a very good point and that very well could be true in his case, but it would be still worth investigating to find out. The other tenants should have a different lease contract then he does if that is the case. One that does not contain those clauses that those specific breeds are prohibited. If the lease contract he signed when he moved in specificly list those dogs as prohibited then he is done anyway. If the management company has made a policy change to their contracts after he signed then he should have been made aware of those changes. |

With my first rottie I lived in a duplex that had a yard. I rented from a private landlord. Worked out good for me. |
