Court says pit bull restrictions are NOT valid!! (Reading, PA)

Pa. court tosses Reading’s aggressive-dog ordinance

February 26, 2008

HARRISBURG, Pa. (AP) — A Pennsylvania appeals court says a Reading City ordinance that placed restrictions on pit bulls is not valid because the state’s dog law pre-empts it.

The Commonwealth Court decision issued Tuesday sides with two pit bull owners who’ve been fighting the city’s dog law since 2000.

Reading’s ordinance had defined aggressive dogs as breeds that account for 40 percent or more of dog bite incidents in the city during a given year.

Those dogs had to be muzzled when they’re outside the home and on a leash shorter than three feet long.

The city’s law called for fines of up to $1,000 or 30 days in jail.
